Terms of Service

1. Account Registration and Access

• Age Requirements: You must be at least 13 years old (or the minimum age required in your country) to use the App. If you are under 18, you must have parental permission. Business API users must be at least 18 years old.
• Verification: Account creation requires a valid phone number or authenticated credential. You agree to provide accurate information and maintain the security of your device and account access.

2. Content, Inputs, and AI Outputs

Mesergram provides intelligent messaging features powered by artificial intelligence.

• Your Content: You retain all ownership rights to the text, images, and data you submit to our services (“Input”).
• AI Generated Output: To the extent permitted by law, Mesergram assigns to you all rights, title, and interest in the responses generated by our AI features based on your Input (“Output”).
• AI Disclaimers: Output is generated by machine learning models. You acknowledge that AI Outputs may occasionally be inaccurate, incomplete, or biased. You must not rely on Outputs as a sole source of truth or as a substitute for professional legal, medical, or financial advice.

3. Acceptable Use Restrictions

You agree not to use Mesergram to:

• Violate any applicable local, national, or international laws.
• Generate, share, or transmit harmful, deceptive, or abusive content, or facilitate mass spamming.
• Reverse-engineer, decompile, or attempt to extract the underlying source code or machine learning model weights of the Mesergram network.
• Use Outputs to develop or train competing artificial intelligence models.

4. Consumer App Specific Terms

• Personal Use: The App is provided for personal or standard professional messaging.
• Automation Limits: Automated bots are permitted only via official developer bot APIs. Scraping or mass-automating user accounts without authorization is strictly prohibited.

5. Business API Specific Terms

• License and API Keys: Mesergram grants businesses a limited, non-exclusive, non-transferable right to access the Business API. You are solely responsible for all activity occurring under your API keys.
• Commercial Conduct: Businesses using the API to message customers must comply with standard messaging policies (e.g., obtaining explicit opt-in consent from end-users before messaging).
• Data Processing: Mesergram will not use data submitted through the Business API to train or improve our public AI models.
• Fees and Billing: API usage is subject to tier-based pricing or credit consumption. Unpaid balances will result in immediate API suspension.

6. Limitation of Liability and Indemnification

Mesergram is provided “as-is”. Except where prohibited by law, Mesergram and its affiliates will not be liable for any indirect, incidental, or consequential damages. You agree to indemnify Mesergram against third-party claims arising from your breach of these Terms or misuse of the Business API.
